How Breaks Work in Practice
•The meal break must be taken before you hit the 5-hour mark (or within the 5th hour) under most awards.
•You can't be forced to work through a legally required meal break.
•The 10-minute rest break is paid — the clock keeps running.
•Your employer decides when the breaks are taken, but they must be given.
What if you don't get your breaks?
If your employer isn't giving you the breaks you're entitled to under your award, that's a breach. Here's what to do.
Raise it with your manager first — in writing if possible.
Keep a record of every shift where you were denied a break.
