How Breaks Work in Practice
•The 9th hour is usually overtime. Check your award for time-and-a-half or double-time rates.
•The break structure is the same as an 8-hour shift in most awards — the longer length kicks in with pay, not extra breaks.
•Some awards require an additional short break once you cross the 9-10 hour mark.
•You still need a 10-hour break between shifts under most awards.
What if you don't get your breaks?
If your employer isn't giving you the breaks you're entitled to under your award, that's a breach. Here's what to do.
Raise it with your manager first — in writing if possible.
Keep a record of every shift where you were denied a break.

Usually yes. Most awards treat hours beyond 8 or 38/week as overtime, paid at time-and-a-half for the first two or three hours and double-time after that.
Do I get an extra break on a 9-hour shift vs an 8-hour shift?
Not usually. The break structure is the same under most awards — the difference is in the pay, not the breaks.
