How much redundancy pay am I entitled to in Australia?
Under the NES, redundancy pay ranges from 4 weeks (1-2 years of service) to 16 weeks (9-10 years). Small businesses with fewer than 15 employees are exempt. Some awards and agreements provide more.
How long does my employer have to pay me after I leave?
Your employer must pay all outstanding wages, accrued leave, and any notice or redundancy pay within 7 days of your last day, or on the next regular pay day — whichever is earlier. Some states have stricter rules.
Can I claim unfair dismissal if I was on probation?
You generally cannot make an unfair dismissal claim until you complete the minimum employment period: 6 months for most employers, or 12 months if your employer has fewer than 15 employees. General protections claims have no minimum period.
Do I get paid out my annual leave when I resign?
Yes. All accrued but untaken annual leave must be paid out on termination regardless of how you leave — resignation, redundancy, or dismissal. Leave loading may also apply depending on your award.
