How Breaks Work in Practice
•The 5-hour rule is the key threshold. Most awards only force a meal break once you've worked more than 5 hours straight.
•Retail and fast food employees often still get one 10-minute paid tea break on a 4-hour shift.
•If you're working multiple short shifts in a day, each shift is treated separately for break purposes.
•Minimum shift lengths apply too — 4 hours is the minimum engagement under many awards for casuals.
What if you don't get your breaks?
If your employer isn't giving you the breaks you're entitled to under your award, that's a breach. Here's what to do.
Raise it with your manager first — in writing if possible.
