Is it a legal requirement to hold toolbox talks in Australia?

No — there is no law requiring you to hold a toolbox talk specifically. What WHS law requires is consultation with workers, so far as reasonably practicable (s47), on matters including hazard identification, risk assessment, control decisions, welfare facilities and proposed changes (s49). A toolbox talk is one accepted way to meet that duty — there's no prescribed format, topic list or frequency in law.

How often should toolbox talks be held?

There's no legally mandated frequency. Weekly talks on active construction sites and pre-shift talks before high-risk work are common industry practice, not a legal minimum. What matters legally is that consultation actually happens whenever one of the s49 trigger events occurs — a new hazard, a control decision, a change to welfare facilities, or a proposed change affecting health or safety.

What does the law actually require instead of a toolbox talk?

The WHS Act's consultation duty: s47 requires consulting workers so far as reasonably practicable; s48 sets out how — sharing relevant information, giving workers a reasonable opportunity to express views, taking those views into account, telling them the outcome, and involving the elected Health and Safety Representative (HSR); s49 sets out when — hazard identification, risk assessment, control decisions, welfare facilities and proposed changes. A toolbox talk with an attendance record is one way to document that you've done this.

Does a toolbox talk need to involve the Health and Safety Representative?

If your workgroup has an elected HSR, yes — s48 requires involving them in consultation on the matters in s49. If no HSR is elected for the workgroup, that element doesn't apply, and the talk is scored against the other four consultation elements instead.
