Am I eligible for casual conversion?

Under the 2024 Closing Loopholes reforms (section 66AAB of the Fair Work Act), a casual employee who has been employed for at least 6 months and believes they no longer meet the casual-employment definition can notify the employer of their choice to convert to permanent. 12 months applies for small business employees.

How long does my employer have to respond?

21 days in writing. The employer must consult with you before responding. If refused, the refusal must be on one of the grounds set out in the Act — for example, that you still meet the casual-employment definition, or that the conversion would require significant changes to hours or pattern of work that cannot reasonably be accommodated.

What if my employer refuses or doesn't respond?

You can escalate to the Fair Work Commission for arbitration if the employer refuses without valid grounds or fails to respond in time. Call the Fair Work Ombudsman on 13 13 94 for free advice before escalating.
