What is a show-cause letter and how long do I have to respond?

A show-cause letter asks you to explain why you should not be disciplined or dismissed in response to allegations. Employers usually give a short window — often 24 hours to 7 days. If you need more time to respond properly, especially while you wait for the specific particulars of each allegation, it is reasonable to ask for an extension in writing. A fair process gives you a genuine opportunity to respond before a decision is made.

Do I have to admit anything in a show-cause response?

No. You can respond to a show-cause letter, give your own account, and request the specific particulars and evidence behind each allegation — all without accepting that the allegations are correct. Responding is not an admission. If the conduct alleged could also be a criminal matter, be careful what you put in writing and get advice first.

What happens if I'm dismissed after a show-cause process?

If a dismissal follows, the Fair Work Commission can consider whether there was a valid reason and whether you were given a genuine opportunity to respond — including enough particulars and time. The general protections in Part 3-1 of the Fair Work Act 2009 also prohibit adverse action for exercising a workplace right. There is a strict 21-day time limit to apply to the Fair Work Commission after a dismissal, so act quickly and get advice.
