Should I sign a written warning at work?

Employers often ask you to sign a warning to acknowledge that you received it — not to agree that the concerns are correct. If the form blurs the two, you can write 'Acknowledged receipt only — I do not agree with the concerns' next to your signature. Better still, respond in writing using a letter like this one so your side is on the record from the start.

Can I respond to a warning without admitting I did anything wrong?

Yes. You can acknowledge that you received the warning, give your own account of what happened, and ask for the specific incidents and standards it relies on — all without accepting that the concerns are correct. A calm, factual response that reserves your rights under the Fair Work Act 2009 keeps the record fair if the situation escalates.

What happens if I'm dismissed after a warning?

If a dismissal follows, the Fair Work Commission can consider whether there was a valid reason and whether you were given a fair opportunity to respond. The general protections in Part 3-1 of the Fair Work Act 2009 also prohibit adverse action for exercising a workplace right. Importantly, there is a 21-day time limit to apply to the Fair Work Commission after a dismissal, so act quickly and get advice.
