Minimum Hours

There is no universal minimum number of hours for part-time work under the Fair Work Act. However, many Modern Awards set a minimum engagement of 3 or 4 hours per shift. Your written agreement must specify your ordinary hours, the days you work, and start/finish times.

Leave Entitlements (Pro-Rata)

Permanent part-time employees receive the same types of leave as full-time workers, calculated proportionally. This includes 4 weeks annual leave, 10 days personal/carer's leave, 2 days compassionate leave, and unpaid parental leave. Leave accrues based on your ordinary hours — for example, working 20 hours per week means you accrue leave at roughly half the full-time rate.

Casual Conversion

If you have been employed as a casual for 12 months (or 6 months for small businesses under some awards) and have worked a regular pattern of hours for at least the last 6 months, your employer must offer you conversion to permanent part-time or full-time employment. You can also request conversion. This right is set out in the Fair Work Act 2009 (as amended).

How Part-Time Pay Is Calculated

Part-time pay is calculated on a pro-rata basis — meaning your salary and entitlements are proportional to the hours you work compared to full-time hours (usually 38 hours per week).

The formula is straightforward:

Annual salary = Hourly rate × Hours per week × 52

For example, if you earn $32.00/hr and work 24 hours per week:

  • Annual gross: $32.00 × 24 × 52 = $39,936
  • Pro-rata fraction: 24 / 38 = 63.2% of full-time
  • Super (12%): $39,936 × 0.12 = $4,792 (paid by employer)

Income tax and Medicare levy are then calculated on your annual gross using the standard ATO tax brackets for 2025-26. Your take-home pay is your gross minus these deductions.

Income tax, Medicare levy, and super are then calculated on that annual figure, with super (12%) paid on top by your employer.
