What is the Fair Work Information Statement?

The Fair Work Information Statement is a document employers must give all new employees before or as soon as practicable after their start date.

The Fair Work Information Statement (FWIS) is a document produced by the Fair Work Ombudsman that summarises key workplace rights and entitlements under the Fair Work Act. Employers must give it to every new employee before or as soon as practicable after the employment starts. There is also a separate Casual Employment Information Statement for casual employees.

The FWIS covers the NES, Modern Awards, enterprise agreements, freedom of association, termination of employment, right to request flexible working arrangements, and how to get help from the Fair Work Ombudsman. Employers must provide the most current version — it is updated periodically.

What happens if my employer didn't give me the FWIS?

Not providing the FWIS is a contravention of the Fair Work Act. While it does not affect your entitlements (you have them regardless), you can report the breach to the Fair Work Ombudsman.
