What is a stop bullying order?

A stop bullying order is an order the Fair Work Commission can make to stop workplace bullying from continuing against a worker.

A stop bullying order is an order the Fair Work Commission can make under section 789FF of the Fair Work Act 2009 to prevent a worker from being bullied at work. A worker can apply if they reasonably believe they have been bullied and there is a risk it will continue.

Workplace bullying means repeated unreasonable behaviour towards a worker that creates a risk to health and safety. A stop bullying order is preventative — it is designed to stop the bullying continuing, not to award compensation. Reasonable management action carried out in a reasonable way is not bullying.

Frequently asked questions

Can I get compensation from a stop bullying order?

No. A stop bullying order under section 789FF is about stopping the bullying from continuing, not about paying you money. If you are seeking compensation, a different process — such as a general protections or workers' compensation claim — may apply.

Is my manager's feedback bullying?

Not on its own. Reasonable management action carried out in a reasonable way — including performance feedback and lawful directions — is not workplace bullying, even if you find it unwelcome.
