Can my employer treat me badly for raising a workplace grievance?

Making a complaint or enquiry in relation to your employment is a workplace right protected under the general protections in Part 3-1 of the Fair Work Act 2009 (section 341). An employer is not allowed to take adverse action against you because you exercised that right. If you believe you have been treated badly for raising a grievance, the Fair Work Ombudsman offers free information on 13 13 94 (fairwork.gov.au).

How should I word a formal grievance letter?

Keep it calm and factual. Describe what happened in plain terms, give the relevant dates, and say clearly what outcome you are hoping for. Avoid labels and accusations — set out your own account in good faith and ask for the matter to be handled through the appropriate internal process. This template uses hedged, first-person language for exactly that reason.

Who do I send a workplace grievance to?

Usually your manager, a more senior manager, or the HR contact named in your workplace's grievance or dispute-resolution procedure. Many modern awards and enterprise agreements set out a dispute-resolution process. If you are unsure who should handle it, you can ask in the letter and the Fair Work Ombudsman can explain the general process.
