How much notice do I have to give for unpaid parental leave in Australia?

Under section 74 of the Fair Work Act, an eligible employee must give at least 10 weeks' written notice of the intended start and end dates of unpaid parental leave, and confirm those dates (or advise of any change) at least 4 weeks before the leave starts.

Am I entitled to 12 months of unpaid parental leave?

Under section 70 of the Fair Work Act, an eligible employee with at least 12 months' continuous service is entitled to up to 12 months of unpaid parental leave, and may request an additional 12 months. Eligibility and continuous-service rules apply, so check your situation with the Fair Work Ombudsman.

Is unpaid parental leave the same as Paid Parental Leave?

No. Unpaid parental leave under the Fair Work Act is a separate entitlement from the Australian Government's Paid Parental Leave scheme, which is administered by Services Australia. You may be eligible for both, and you deal with the government payment separately.
