Can I ask my employer for copies of my pay slips and employment records?

Yes. Under sections 535 and 536 of the Fair Work Act, employers must make and keep employee records and issue pay slips within one working day of payday. You can ask your employer for copies of your own records, including pay slips, time-and-wages, roster, superannuation and leave records.

How long does my employer have to keep my employment records?

Employee records are generally required to be kept for 7 years under the Fair Work Act record-keeping rules. That means your employer should usually be able to provide records covering recent years of your employment.

What if my employer won't give me my records?

Start by making a clear, polite written request. If records still aren't provided, the Fair Work Ombudsman offers free information and can help on 13 13 94 (fairwork.gov.au). Failing to keep or provide records can be a breach of the employer's obligations under the Fair Work Act.
