How much paid family and domestic violence leave am I entitled to?

Under section 106A of the Fair Work Act, all employees — including casuals — can access 10 days of paid family and domestic violence leave each year. It is available in full from the first day of employment and does not accumulate from year to year.

Do I have to tell my employer the details of my situation?

No. You are not required to provide detailed evidence of the circumstances. Your employer must take reasonable steps to keep any information about your situation confidential. This letter does not state a reason, and you never have to give one to use this leave.

Will this leave show up on my pay slip?

Employers must keep records of this leave, but they are required to avoid putting information on a pay slip that could reveal an employee accessed family and domestic violence leave. If you have concerns about confidentiality, you can raise them with your employer or contact the Fair Work Ombudsman on 13 13 94.
