FAIR ENTITLEMENTS GUARANTEE (FEG)

The Commonwealth FEG scheme covers unpaid entitlements when your employer becomes insolvent. Up to 13 weeks wages + 4 weeks annual leave + 4 weeks long service leave + 16 weeks redundancy. Administered by the Attorney-General's Department.

What entitlements were unpaid?

Estimated FEG claim total: $40,500

Unpaid wages

$19,500

Maximum 13 weeks of unpaid wages from the last 12 months before insolvency. Capped at the FEG weekly maximum.

13 weeks @ $1,500/wk (FEG weekly cap applied)

Unpaid annual leave

$6,000

Up to 4 weeks of accrued annual leave that was owed at the time of insolvency.

4 weeks @ $1,500/wk (FEG weekly cap applied)

Redundancy pay

$15,000

Based on 5.0 years' service per NES scale (10 weeks). FEG caps redundancy at 16 weeks regardless of NES.

10 weeks @ $1,500/wk (FEG weekly cap applied)

How to claim

  1. Wait until the liquidator/trustee has been appointed and the employment has ended (your last working day).
  2. Submit your claim via the FEG online claim system at ag.gov.au/industrial-relations/feg within 12 months of the insolvency event.
  3. Provide: employment contract, last 3 payslips, calculation of unpaid entitlements, proof of identity, liquidator/trustee contact details.
  4. FEG processes claims in about 14-16 weeks on average. Payment goes directly to your nominated bank account.
  5. If you're also owed super, that's claimed separately via the ATO's Superannuation Guarantee Charge process — not FEG.
